USER ACCOUNTS – TERMS & CONDITIONS
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND FRUITFUL VINE MINISTRIES INTERNATIONAL INC. ABN 45 953 524 106 (REFERRED TO AS “FRUITFUL VINE,” “WE,” “US,” OR “OUR”) STATING THE TERMS THAT GOVERN YOUR USE OF FRUITFUL VINE’S USER ACCOUNT SERVICE. THIS AGREEMENT – TOGETHER WITH ALL UPDATES, ADDITIONAL TERMS, AND ALL OF FRUITFUL VINE’S RULES AND POLICIES – COLLECTIVELY CONSTITUTE THE “AGREEMENT” BETWEEN YOU AND FRUITFUL VINE. YOU MUST ACCEPT AND ABIDE BY THESE TERMS AS PRESENTED TO YOU: CHANGES, ADDITIONS, OR DELETIONS ARE NOT ACCEPTABLE, AND FRUITFUL VINE MAY REFUSE ACCESS TO YOUR USER ACCOUNT FOR NONCOMPLIANCE WITH ANY PART OF THIS AGREEMENT. PLEASE NOTE THAT WE DO NOT PROVIDE WARRANTIES FOR THE SERVICE. THIS AGREEMENT ALSO LIMITS OUR LIABILITY. PLEASE READ THE TERMS CAREFULLY.
1. Eligibility For This Agreement
You must be over 18 years of age, or possess parental consent, to sign up for a User Account on the Fruitful Vine website.
2. How You May Use The User Account
In using the User Account, you promise to: obey the law, obey any codes of conduct or other notices we provide, keep your account password secret, and promptly notify us if you learn of a security breach related to the account.
3. You Are Responsible For Your User Account
Only you may use your User Account. You are responsible for all activity that takes place with your User Account. You will be held responsible for any actions taken by an authorised third party user of your User Account.
4. Fruitful Vine’s Privacy Policy
Except as otherwise expressly provided for in this Agreement, the Service is subject to Fruitful Vine’s Privacy Policy, which is expressly made a part of this Agreement. If you have not already read Fruitful Vine’s Privacy Policy, you should do so now.
5. How We May Change This Agreement
If we change this agreement, we will post changes to the website one month before the changes take place. If you do not agree to these changes, you must cancel and stop using the Service before the change takes place. If you do not stop using the Service, then your use of the Service will continue under the changed agreement.
6. We Make No Warranty
Fruitful Vine provides this user account “as-is,” “with all faults,” and “as available.” We do not guarantee the accuracy or timeliness of information available from the account. We and our affiliates give no express warranties, guarantees, or conditions. We exclude any implied warranties including those of merchantability, fitness for a particular purpose, workmanlike effort, and non-infringement.
7. Liability Limitation
In no event will Fruitful Vine be liable to you or any third party for any indirect, consequential, incidental, special, or punitive damages, including lost profit damages arising from your use of the Service. Regardless, Fruitful Vine’s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you for membership and use of the Fruitful Vine website.
8. Changes To The Account
Fruitful Vine may change the User Account, delete features, and/or cancel the account at any time and for any reason. Upon account cancellation, your right to use the account stops immediately. Once the account is cancelled or suspended, any data you have stored on the account may not be retrieved later.
9. Notices We Send You
This Agreement is in electronic form. We may send you certain information in connection with your User Account, and additional information as we deem appropriate, by e-mail to the e-mail address you specified when you signed up for the account.
10. Respect Copyright
Please respect the rights of artists and creators. Content such as music, photo, video, and audio files may be protected by copyright. You may not share other people’s content unless you own the rights or have permission from the owner.
11. Indemnity
You agree to indemnify and hold Fruitful Vine harmless from any loss, liability, claim or demand made because of your use of a User Account in violation of this agreement.
12. Governing Law
The laws of the State of Victoria, excluding its conflicts of law rules, govern these Terms and your use of the Service. Your use of the Service may also be subject to other local, state, national, or international laws. You expressly agree that exclusive jurisdiction for any claim or dispute with Fruitful Vine or relating in any way to your use of the Service resides in the courts of the State of Victoria.
13. Acceptance
You accept and communicate your acceptance of this agreement when you register for a user account. This is the entire agreement between you and Fruitful Vine regarding your User Account.
